There is no banking ombudsman or deposit-compensation scheme for financial services in the Commonwealth of Dominica.
Section 01
General
Please read these Terms and Conditions carefully before accessing or using this website, any Pruvanta-branded digital interface, or any related online feature made available by The Prudential Bank (together, the “Site”). By accessing or using the Site, you agree to these Terms.
References to “Pruvanta” are references to the trading name used by The Prudential Bank. References to “Bank”, “we”, “us” and “our” mean The Prudential Bank and, where the context requires, its successors, assigns, service providers or affiliates. References to “you” and “your” mean the person accessing the Site or using a service.
These Terms primarily govern use of the Site. Banking products and other services may be governed by separate account agreements, product terms, disclosures, cardholder agreements, digital-asset terms, fee schedules or other contracts. If there is any inconsistency, the applicable product or account agreement will prevail in relation to that product or service, while these Terms will continue to govern use of the Site.
Section 02
Legal entity and regulatory status
Pruvanta is a trading name of The Prudential Bank, an international bank existing under the laws of the Commonwealth of Dominica and having its registered office at 1 Emshall, Roseau, Commonwealth of Dominica.
The Prudential Bank is licensed as a banking institution under the Offshore Banking Act and operates under the prudential supervision of the Financial Services Unit of the Commonwealth of Dominica (FSU).
Information about the FSU and its register of regulated financial entities is available at fsu.gov.dm.
Section 03
Eligibility and country restrictions
The Bank may provide services to eligible clients worldwide, except citizens and residents of the Commonwealth of Dominica. Availability remains subject to local law, regulatory requirements, sanctions and financial-crime controls, product eligibility criteria, the Bank’s risk policies and operational capability.
UK and EEA exclusion. The Bank does not offer, market or promote any product or service to, and does not accept Private Early Access requests or applications from, individuals resident in, or companies incorporated or established in, the United Kingdom or the European Economic Area (EEA). This exclusion is confirmed at the point of access to the Site, as described in the notice presented to visitors from these regions.
Not all products or services described on the Site are available in every country or to every person. The Site is not directed to any person in a jurisdiction where the distribution of the information, offering of the relevant service, or use of the Site would be unlawful or restricted.
You are responsible for informing yourself of and complying with the legal, tax, exchange-control and regulatory requirements that apply to you in your country of residence, incorporation or operation.
Section 04
Accounts, onboarding and services
Access to an account or financial service is not automatic. Applications and continued access are subject to the Bank’s eligibility requirements and completion of applicable know-your-customer (KYC), know-your-business (KYB), anti-money laundering (AML), sanctions and other compliance checks.
We may request information and supporting documentation concerning identity, address, business activities, beneficial ownership, source of funds or wealth, transaction purpose, counterparties and other matters reasonably required for legal, regulatory, compliance or risk purposes.
Submission of an application, including an Early Access or account application, does not create a banking relationship and does not guarantee that an account or any particular product will be offered.
Products and services may be subject to additional limits, eligibility rules, transaction restrictions, operational cut-off times, minimum balances, fees and separate contractual terms disclosed when the service is offered.
Section 05
Digital assets and stablecoins
Digital assets are not bank deposits
Digital assets, including stablecoins such as USDT or USDC where supported, are not deposits with the Bank, are not legal tender, may lose value and are not covered by any deposit-protection or compensation scheme.
Digital-asset services may involve risks that do not arise in conventional bank deposits or fiat payments. These may include price volatility, loss of value, stablecoin de-pegging, issuer or counterparty risk, blockchain-network congestion, smart-contract or protocol risk, irreversible transactions, wallet or key-related risks, cyber-security incidents, forks, changes in applicable law and interruptions in third-party services.
The Bank does not guarantee that a stablecoin will maintain any particular value or that an issuer or other third party will redeem a digital asset at par. Where a digital asset references or is intended to track a fiat currency, that reference does not make the digital asset equivalent to a deposit denominated in that currency.
Availability of a particular digital asset, blockchain, deposit method, withdrawal method, conversion pair or settlement route may change, be limited or be unavailable at any time due to legal, compliance, liquidity, technical, market or third-party considerations.
Section 06
No offer or investment advice
Nothing on the Site constitutes investment, legal, accounting or tax advice, or a recommendation to buy, sell, hold or enter into any investment, security, digital asset or financial instrument.
Information on the Site is provided for general information about Pruvanta and the Bank’s services. It does not constitute an offer, solicitation or inducement in any jurisdiction where such offer, solicitation or inducement would be unlawful.
You should obtain independent professional advice where appropriate and make your own assessment of the legal, tax, financial and other consequences of any product or transaction.
Section 07
Fees, exchange rates and tax
Fees, pricing, spreads, exchange rates and product conditions may vary by service, currency, payment rail, jurisdiction and client profile. Applicable charges will be disclosed through the relevant product terms, fee schedule, transaction interface or other communication.
Correspondent banks, card networks, blockchain networks, liquidity providers, intermediaries and other third parties may charge additional fees that are outside the Bank’s control.
Tax rules differ between jurisdictions. You are responsible for determining and meeting your own tax reporting, payment and disclosure obligations. Any tax-related information made available by the Bank is general information only and is not tax advice.
Section 08
Use of the Site
You may use the Site only for lawful purposes. You must not misuse, interfere with, disrupt or attempt to gain unauthorised access to the Site, any account, network, system, data or security mechanism.
You are responsible for the devices, software, connectivity and security controls you use to access the Site and for taking reasonable precautions against malware, phishing and unauthorised access.
Information published on the Site may be updated, corrected, withdrawn or replaced without prior notice.
Section 09
Electronic communications and security
Internet and email communications cannot be guaranteed to be completely secure and may be intercepted, delayed, altered or lost. You should not send passwords, authentication codes or other highly sensitive security credentials by ordinary email.
Existing clients should use authenticated channels made available by the Bank where possible. If you suspect a security breach or unauthorised access, contact the Bank promptly through an official channel.
The Bank will not ask you by unsolicited email or social-media message to disclose a password or authentication code.
Section 10
Third-party services, links and illustrative content
The Site may contain links to third-party websites, infrastructure, applications, payment networks, digital-asset networks or other services. A link or technical connection does not by itself constitute an endorsement. Third-party services are governed by their own terms and privacy practices.
The Bank is not responsible for the availability, content, security, accuracy or performance of third-party websites or services except to the extent responsibility cannot lawfully be excluded.
Marketing placeholders: Company logos, names, quotations or testimonials shown on Pruvanta marketing pages may be illustrative placeholders unless expressly identified otherwise. Their appearance should not be interpreted as confirmation of a customer relationship, partnership, endorsement or affiliation.
Section 11
Service availability and correspondent banking
The Bank’s products and services may depend on the establishment and continued availability of correspondent banking facilities, payment networks, card networks, banking partners, liquidity providers, digital-asset infrastructure, insurance and other third-party arrangements.
As a result, a product, currency, payment route, feature or service may not be available in a particular market, may be subject to limits, or may be suspended, modified, restructured, withdrawn or discontinued on a temporary or permanent basis.
The Bank does not guarantee uninterrupted or continuous availability of the Site or any particular product, payment rail, currency or third-party connection.
Availability of products and integrations. Not all products, features or integrations described on the Site are currently available. Some are in development, offered only through Private Early Access, or available only in certain jurisdictions or to certain client types. Descriptions on the Site are provided for general information and are not a commitment to offer any product, feature or integration. Availability for a specific client is confirmed only during onboarding and remains subject to eligibility, KYC/AML approval and applicable law.
Section 12
Regulatory scope
The Prudential Bank is licensed and regulated by the Financial Services Unit (FSU) of the Commonwealth of Dominica. The Bank is not authorised, licensed or registered as a bank, payment institution, e-money institution or crypto-asset service provider in any other jurisdiction.
Nothing on the Site is directed at, or constitutes an offer, solicitation or promotion of any product or service to, persons in a jurisdiction where such offer, solicitation or promotion would require a licence, registration or authorisation the Bank does not hold.
Persons accessing the Site from such jurisdictions do so on their own initiative and are responsible for ensuring that engagement with the Bank complies with the laws applicable to them.
Section 13
Intellectual property
Unless otherwise stated, the Site, its page designs, text, graphics, interfaces and other materials are owned by or licensed to the Bank or its relevant service providers and are protected by applicable intellectual-property laws.
You may view and make reasonable copies of Site materials for your own personal or internal business use. You may not reproduce, republish, modify, distribute, commercially exploit or incorporate material from the Site into another website or service without prior permission, except where applicable law permits otherwise.
Section 14
Privacy and data protection
The Bank may collect and process personal information when you use the Site, apply for an account, communicate with us or use a service. Such processing is subject to the applicable privacy notice and any additional privacy information provided in connection with a product or service.
You should review the Bank’s Privacy Policy for further information about how personal data may be collected, used, retained and shared.
Section 15
Complaints
If you are dissatisfied with a product, service or interaction with the Bank, please contact us as soon as possible so the matter can be reviewed and, where appropriate, remedied.
Existing clients should use the authenticated support or contact channels made available through their account where possible. Other enquiries may be sent to [email protected].
There is no banking ombudsman or compensation scheme for financial services in the Commonwealth of Dominica.
Section 16
No warranties and limitation of liability
To the extent permitted by applicable law, the Site and information made available through it are provided on an “as is” and “as available” basis. While reasonable steps may be taken to maintain the accuracy and availability of Site information, the Bank does not warrant that the Site will always be accurate, complete, current, uninterrupted, error-free or free from harmful components.
To the maximum extent permitted by law, the Bank will not be liable for loss arising solely from reliance on general information published on the Site, the unavailability of the Site, or third-party content or services linked from it. Nothing in these Terms excludes or limits any liability or statutory obligation that cannot lawfully be excluded or limited.
Section 17
Changes to these Terms
We may amend these Terms from time to time by publishing an updated version on the Site. The date at the top of this page indicates when the Terms were most recently updated.
Your continued use of the Site after an updated version is published constitutes acceptance of the updated Website Terms to the extent permitted by applicable law. Changes to an account or product agreement will be handled in accordance with the terms of that agreement and applicable law.
Section 18
Governing law and disputes
These Terms, and dealings with the Bank in connection with the Site, are governed by the laws of the Commonwealth of Dominica, subject to any mandatory rights or rules that apply under applicable law.
The contractual language is English and communications with the Bank may be conducted in English. If a dispute arises, we encourage you to contact the Bank first so that the matter can be reviewed through the Bank’s support and complaint process.
As stated above, there is currently no banking ombudsman or financial-services compensation scheme in the Commonwealth of Dominica.
